Morocco’s Trade Register: register, amend and keep the file current

Understand local and central registers, initial registration, amendments, cancellation, extracts and evidence throughout the business lifecycle.

The Trade Register is not a document you obtain and forget. It publicly tells the identity and changes of a trader or company. Register in the competent register, record events that alter the entry and retain current evidence: that keeps a landlord, bank or supplier from reading a different version of the business.

The register in four verbs

  • Register the natural or legal person concerned.
  • Record changes affecting declared data.
  • File required acts at the correct level.
  • Cancel the entry when activity or person ends in prescribed cases.
  • Order a certificate or copies where evidence is requested.
  • Distinguish local and central registers.
  • Attach relevant branches, agencies and establishments.

1. Understand the two levels

The Trade Register includes local registers held at competent courts and a central register held by OMPIC.

2. Prepare initial registration

First identify who registers, the principal establishment and the activity actually carried on.

  1. Choose the natural-person or legal-person path.
  2. Check the seat or principal establishment and territorial competence.
  3. Align name, form, activity, address and identifiers.
  4. Gather acts and evidence specific to the case.
  5. File through DirectEntreprise or the confirmed route.
  6. Check the result, number and transcribed data.

The Commercial Code notably provides three months after opening a commercial establishment or acquiring a business for the relevant trader’s registration. Do not treat the deadline as a target: prepare before opening.

3. Register a real change

An address, name, sign, activity, capital, form, officer or branch opening may require an amending entry and related acts.

The requested evidence is not always the same

A registration certificate, copy of entry, copy of act or DirectInfo search answers a different need. Ask the recipient which document and date they accept.

4. Cancel without erasing history

Cessation, dissolution or other prescribed situations may call for cancellation. It is not deleting a software account or leaving premises: decisions, tax, social security, liquidation, notice and register must be coordinated for the case.

  • Operating cessation: real date and inventory
  • Legal decision: competent act
  • Public obligations: tax, CNSS, publications and register
  • Archive: intact records and exports

Keep evidence after cancellation for applicable periods. Old acts, books and data may remain needed for an audit, debt or liquidation.

5. Align register and reality

After every confirmation, compare current evidence with what customers and teams see.

  • Name and form on documents.
  • Address and establishment for each sale.
  • Correctly copied identifiers.
  • Users and outlets attached to the right site.
  • Old details removed without losing history.
