Invoice without VAT in Morocco: when and how to present it

Exempt, outside scope and suspensive treatment are not synonyms. Document the basis, show totals and avoid a fictional generic 0% rate.

An invoice without VAT is not an ordinary invoice where someone merely types “0%”. First qualify why tax is not charged, then display wording that actually corresponds to the transaction. Article 145 of the Moroccan Tax Code provides that, for operations under Articles 91, 92 or 94, the VAT statement is replaced by an indication of the exemption or suspensive treatment. The exact basis still has to be validated for your case.

The safe method

  • Identify issuer, customer, transaction and date.
  • Distinguish non-liability, outside scope, exemption and suspension.
  • Obtain the applicable article, paragraph and evidence.
  • Do not invent a universal 0% rate.
  • Display validated wording next to the relevant totals or lines.
  • Keep net, zero VAT and gross readable under the chosen model.

1. Four situations not to mix

Two invoices showing no tax can have different bases and consequences. “Without VAT” only describes the visible outcome; it provides neither the reason nor the right to deduct.

2. Build the invoice without ambiguity

The invoice still carries identity, continuous number, date, customer, lines, quantities, prices and payment. Only the tax presentation changes with the basis.

  1. Create the customer and professional ICE where required.
  2. Describe the good or service and period.
  3. Calculate every line from the agreed price.
  4. Separate lines where their treatments differ.
  5. Apply the validated treatment, not a default.
  6. Display exact wording and reference where required.
  7. Show base, tax charged and total without contradiction.
  8. Review the PDF and exported data.
  9. Attach or file necessary evidence.
  10. Approve the first case and every regime change.

The brackets are deliberate: no universal sentence fits every invoice without VAT. Replace them with wording confirmed for the transaction, never with “exempt” by intuition.

3. Multiple lines or treatments

If one invoice combines taxable and untaxed operations, a single “VAT 0” column is misleading. Group bases and amounts by treatment and attach wording to the correct lines.

0% is not a legal reason

A zero software field is a calculation value. It proves neither exemption, outside scope, suspensive treatment nor compliance with their conditions. Retain the tax decision, text and evidence outside the product setting.
